Notices and Entry A landlord must notify a tenant 24 hours in advance to entering a rental unit for repairs or property showings. (735 ILCS 5/9-102) However, if there is an emergency, a landlord is not required to give notice. In Chicago, a landlord must give a 48 hour notice of entry.
Notice Requirements for Illinois Landlords A landlord can simply give you a written notice to move, allowing you 30 days as required by Illinois law and specifying the date on which your tenancy will end.
Tenants may not own their apartment, but they do own the possessory right to that apartment: they are entitled to exclusive possession of their entire apartment for the term of the lease. Unless the citys law provides otherwise, even landlords are not allowed to enter a leased apartment without permission.
Under the federal Fair Housing Act and Illinois law, it is unlawful for a landlord to discriminate in the leasing of a dwelling house, flat, or apartment against prospective tenants who have children under the age of 14 years.
If the repair is required by law, or by the lease, the landlord has 14 days (or less, if it is an emergency) to repair. If not, the tenant can repair and deduct. This means they can pay to have the repair made, and then pay less rent the next month to cover the bill.
Access to the Premises The landlord may enter the rental unit on reasonable notice to the tenant and at a reasonable time to make repairs to the premises. Reasonable notice is defined as 12 hours prior to entry, and reasonable time is defined as between the hours of 7:30 a.m. and 8 p.m.
Texas courts have held that a landlord may not enter your home unless you allow the entry or the lease gives the landlord specific reasons to enter.
Ohio Revised Code 5321.04(A)(8) states that a landlord must: Except in the case of emergency or if it is impracti- cable to do so, give the tenant reasonable notice of the landlords intent to enter and enter only at reasonable times.
