You Have the Right to Decline a Reference Request There is never an obligation to give someone a reference. You can politely and diplomatically decline the request without offending the person who asked you. The trick is to do so without making your refusal sound like a personal criticism or a professional rejection.
If a reference contains sensitive information you should mark it as Confidential, though this will not guarantee that it will not be disclosed in the event of a subject access request. Also, it is good practice always to mark references as Confidential in case they contain sensitive personal data.
Your human resources department does not have to give references for former employees. There is no law that mandates this, and your company cannot get in trouble for refusing to comply with reference requests.
