In addition, click on the provided hyperlinks for complete written instructions on how to properly assign a filing basis. For example, if you are filing an application that has one basis for all goods and services, click the link and follow the provided instructions. The two most common filing bases are Section 1(a) Use-in-Commerce and Section 1(b) Intent-to-Use. Section 1(a) is for when you are already using your mark in interstate commerce. Section 1(b) is for when you are not yet using the mark in interstate commerce, but you have a bona fide intent to do so within the next 3-4 years. The person signing must insert his or her own signature between the forward slash marks, 1.4(d)(2)(i). The name of the person signing must be printed or typed immediately adjacent (i.e., below, above, or beside) to the S-signature, and be reasonably specific, so the identity of the signer can be readily recognized.
Relatively minor mistakes in an issued U.S. patent may be corrected by means of a certificate of correction. Correctable mistakes are of three basic types: (a) errors incurred through the fault of the USPTO; (b) errors made by the applicant; and (c) errors regarding the named inventors.
In requesting the Office to effectuate a court order correcting inventorship in a patent pursuant to 35 U.S.C. 256, a copy of the court order and a certificate of correction under 37 CFR 1.323 must be submitted to the Certificates of Correction Branch. In addition, form PTO/SB/44 should be filed.
Change of Owner (Assignment) and Change of Owner Name The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
Correcting the Inventors This can be done by the United States Patent and Trademark Office (USPTO) or by court order. The USPTO requires a petition stating that it was an error and all the parties and assignees must make the application, agreeing it should be corrected.
A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act 14.
More information about certificates of correction can be found in MPEP chapter 1481. A reissue is used for making more substantive changes or corrections than a certificate of correction is used for. It is an option that is only available to patent owners, and it requires a fee.
The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
