Legally, yes, you can contact references without permission and backdoor reference checking isnt illegal. The decision is up to you, but its highly recommended that you respect the candidates request not to contact certain references.
When you need a more personal character reference, you can ask one of the following: Coach. Neighbor. Minister. Community leader. Volunteer coordinator. Parent of a close friend. If your old employer doesnt want to give you a reference, you could ask them just to give a short one - known as a basic reference.
