- Hey guys, Clint Coons here, and in this video, I want to talk about the use of deeds, and put a little different spin on it that you may not be aware of, on how you can go about deeding your property without anybody knowing. Okay, lets get started. (lively rock music) All right, so heres the deal. If youve bought property before, you know what a deed, how a deed works, right? People get a deed, they transfer property to someone. You receive your deed if youve bought the property. You take that deed down to the county recorder. You record it right away. And now youre listed as the legal owner on title to that real estate, so the whole world at large knows. So a lot of people assume that in order to transfer title for a legally enforceable deed, you have to record it. Well, that is not the case. When youre transferring title to property, the recording aspect of a deed isnt necessary. Now, its important. Dont get me wrong, all right? You want to protect yourself against claims

If a seller fails to disclose, or actively conceals, problems that affect the value of the property; they are violating the law, and may be subject to a lawsuit for recovery of damages based on claims of fraud and deceit, misrepresentation and/or bdocHub of contract.
If the seller bdocHubes a contract and basically refuses to close on a property in the state of Florida, the buyer has potentially the remedy of specific performance. Of course, this must be drafted into the contract before the parties execute a contract.
Under Florida law, a Seller will not be held liable for everything he/she fails to disclose to a buyer. Only material misrepresentations will support a fraud claim. Additionally, the damage to the value of the property must be proven; it cant be speculative or subjective.
Florida law requires sellers to disclose any issues they know about that materially affect the value of a home or property. This requirement applies even if the buyer does not ask whether the seller knows about defects.
If the borrower defaults, the lender has a remedy: to foreclose on the property. However, for some would-be home buyers, obtaining financing for the purchase of real property is not an option. Some prospective purchasers may have bad credit (or no credit) and/or no one to co-sign on a loan for them.
These are the typical terms in a land contract: Name and address of all parties. A description of the property. Acknowledgement of the person who owns the property.
A land contract is typically between two parties: the buyer sometimes referred to as the vendee and the seller, also known as the vendor. In a land contract, the seller agrees to finance the property for the buyer in exchange for the buyer meeting the terms agreed upon in the land contract.
Under Florida law, a buyer can sue for damages, and even rescind a transaction, where a seller or real estate agent doesnt reveal a known material problem with the home prior to purchase.
