This can be enormously frustrating. Im here to help you know what to do when your child custody agreement fails. Unfortunately this happens all too often and we know exactly why your child custody agreement failed. And it wasnt your fault, was it? I know. Its hard to deal with an ex. Especially one who doesnt quite get it. You know, the importance of this agreement that you came up with. I as a professional psychologist spent 13 years of my career doing child custody evaluations for the court. I have seen it. Ive seen all the tactics that are used. Ive seen the nasty things that can happen and Ive seen the way that it hurts children. And not only the kids but their parents too. This has to do with you but really its about the kids. And I want to help create solutions in this world that will serve our children better. So, listen up for a minute about the custody agreement. Parental alienation is a strategy whereby one parent intentionally displays to the child unjustified negativity aimed at the other parent. The purpose of this strategy is to damage the childs relationship with the other parent and to turn the childs emotions against that other parent.
Each parent is entitled to know where the children are during visitations. They should also know if the children are left with other people such as babysitters or friends when the other parent is not there.
Do I have the right to know where my child is during visitation? Yes if you have a custody order specifying that parents must disclose the childs whereabouts during their visitation time. Its a violation of the order if a parent refuses to reveal the childs location.
The answer is usually no, a parent cannot stop a child from seeing the other parent unless a court order states otherwise. This question often comes up in the following situations. The parents (whether married or unmarried) are no longer together and the child resides with one of the parents.
The General Rule A parent cannot stop the other parent from seeing the children, except in rare situations. This means that contact cannot be prevented, even in situations like these: A parent refuses to pay child support.
Unless a court order authorizes such action, one parent cant block another parent with custodial rights from contacting their own child. Otherwise, the blocked parent will have legal recourse through the family courts.
Unless there is a court order prohibiting your ex-spouse from exposing the children to a romantic interest, there is little you can do. As the custodial parent, you dont have the right to control your Exs life. You do however have the right to know where your children are and who they are spending time with.
But, yes you may be able to limit who has contact with your children while in your spouses care and this can be either through agreement or by court order. Remember, a court will look out for the best interest of the child. The most valid reason for wanting to limit contact is abuse (sexual, verbal, physical).
