Design patent drawings must clearly show every feature visible during use. No part of the objects design should be left to the imagination. Drawings should include shading that indicates surface characteristics. The shaded areas can depict transparent, solid, and open areas.
The patent drawings in a design patent application need to include enough views to fully show the appearance of a claimed design. For example, this would often include front, rear, top, bottom, right, and left views of a three-dimensional object.
Color drawings are acceptable in US patent applications, but not in international applications (see PCT Rule 11.13).
The use of dashed lines, or broken lines, in design patent drawings means that whatever is drawn in such lines is not claimed. In a US design patent, the claimed design comprises what is drawn in solid lines.
For Design Patent Drawings the USPTO requires all surfaces of an object shown in the drawings to be appropriately and adequately shaded: Shading which shows clearly the character and contour of all surfaces of any three- dimensional aspect of the design.
Solid black surface shading is not permitted except when used to represent the color black as well as color contrast.
Drawings submitted to the Office must be made on paper which is flexible, strong, white, smooth, non-shiny, and durable. All sheets must be reasonably free from cracks, creases, and folds. Only one side of the sheet may be used for the drawing.
Some of the important line types those we can use in drawings for patents are Solid Line, Phantom Line, Projected Line, Hidden Line, and Boundary Line. These lines help the patent examiner to clearly understand the invention and get an idea of how the invention looks like to improve the scope of getting the patent.
If you want to patent a design, you can file a Design Patent Application with the United States Patent and Trademark Office (USPTO). Design patents only protect the look of an object. They arent the same as utility patents, which cover how objects work and how theyre used.
