What is not PHI? De-identified health information neither identifies nor provides a reasonable base to identify an individual. Health information by itself without the 18 identifiers is not considered to be PHI. For example, a dataset of vital signs by themselves do not constitute protected health information.
Health information in education records that are subject to the Family Educational Rights and Privacy Act (FERPA) is not considered protected health information (PHI) under HIPAA. For example, a childs K-12 records containing information about school nurse visits are not subject to HIPAA.
It is not a HIPAA violation to email patient names per se, although patient names and other PHI should not be included in the subject lines of emails as the information could easily be viewed by unauthorized individuals.
If patient initials are maintained in a data set that does not contain health information (i.e., initials, surname, and telephone number), none of the information in the data set is PHI because they do not relate to the individuals health information.
PHI does NOT include any information that identifies the individual or could reasonably be used to identify the individual. PHI is NOT information maintained in employment records within the Human Resources Department or student files in an academic medical facility.
