3011. In making a determination of the best interest of the child in a proceeding described in Section 3021, the court shall, among any other factors it finds relevant, consider all of the following: (a) The health, safety, and welfare of the child.
This section can be used to award custody of a child to a step-parent or guardian. That is to say that California courts will grant custody to a parent before any third party unless it is not in the best interest of the child to do so.
When there are no court orders in effect, both parents have equal rights to their child(ren). It is unlawful however for one parent to conceal the child(ren) from the other parent, or for a parent not to provide some form of contact/visitation to the other parent.
Stepparent Visitation The Court may grant reasonable visitation to a stepparent if it is in the childs best interest [Family Code section 3101].
One statute is Family Code Section 3111. This section authorizes the Court to order a child custody evaluation when it is seeking to issue an order as to the best interests of the child(ren).
Parental child abduction occurs when a parent or other family member who does not have court-ordered visitation or custody rights runs away with a child and hides them for any period. Under California PC 278, parental kidnapping, also called child theft, is illegal.
Who Has Custody of a Child if There Is No Court Order in California? If a court order is not in effect, both parents have legal custody of the childassuming that the father has already established legal paternity. If the father has not established paternity, the mother retains child custody.
From there, a court could order temporary visitation during the process and finalize visitation once paternity is established. A mother can keep her child away from the father if there is a legitimate fear of danger or harm.
Code 3010. Current through the 2022 Legislative Session. Section 3010 - Entitlement to custody (a) The mother of an unemancipated minor child and the father, if presumed to be the father under Section 7611, are equally entitled to the custody of the child.
