When health information does not identify an individual, and there is no reasonable basis to believe that it can be used to identify an individual, it is de-identified and is not considered to be PHI.
De-identified information is PHI stripped of identifiers in a manner that results in information that is no longer protected by the Privacy Rule. There are two de-identification methods: formal determination by a qualified expert or the removal of 18 specified identifiers, also known as the safe harbor method.
De-identified health information, as described in the Privacy Rule, is not PHI, and thus is not protected by the Privacy Rule. PHI may be used and disclosed for research with an individuals written permission in the form of an Authorization.
