[Music] hello again everyone Im attorney Robert fleshes before you enter into a residential lease agreement as a tenant or if youre a landlord drafting a rental agreement to give to a tenant you really need to watch this video Im going to tell you about seven possible provisions that could be included in the lease that could be illegal rendering the entire lease void which means the lease isnt enforceable and if you find this video helpful please consider subscribing to my channel remember that every state has different landlord tenant laws but the seven contract terms that Im going to discuss in this video are probably illegal in most states the illegal terms that Im discussing do not impose criminal liability on the landlord first lets talk about the form of the lease many landlords download boilerplate leases from the internet in order to avoid paying attorney to prepare a valid and effective residential lease or to pay for a state-approved lease containing enforceable terms

A landlord may only cancel an agreement should the tenant have materially bdocHubed the terms of the agreement. The most common form of bdocHub by a tenant is the failure to make payment of rent and other amounts due.
Section 14(2) of the Consumer Protection Act 68 of 2008 provides that the tenant must give 20 business days written notice to the landlord of their intention to terminate the lease agreement.
BdocHub of lease If a tenant fails to pay rent, and there is a reason to suspect that the tenant may not pay future rent, the landlord may cancel the lease. However, it is not always a simple case and you will need to get the court on your side as a landlord.
Here is an example of a rent amount clause in a lease: The Tenant agrees to pay $12,000 as rent, to be paid as follows: $1,000 per month, due on the 1st day of each month. Payment of the first months rent and any security deposit is due upon the signing of this Lease by the Tenant.
Both the landlord and tenant must give at least one months notice to the other party when wanting to cancel the lease. (See Rental Housing Act 1999.) The Consumer Protection Act (CPA) gives additional rights to the tenant by allowing them to cancel the lease provided 20 business days notice is given.
The Consumer Protection Act (CPA) requires the Landlord to give the Tenant written notice of not less than 40 days and not more than 80 days before the lease expires, to decide whether they are going to renew their lease agreement or not.
A lease agreement is entered into when one person (landlord) gives use and enjoyment of his/her property to another person (tenant) for a specific period of time in return for the payment of rent. It is not a requirement for the lease agreement to be in writing.
Preparing a Residential Lease in Florida Is a Lease Agreement Binding? Any contract to lease signed in Florida is legally binding, considering it was drafted and signed in full compliance with the legal requirements.
