Communicating Intentions. There is no set formula for creating a restricted gift. All that is needed is an offer to give a gift to a charity for a specific purpose (that is, a purpose more restrictive than the charitys stated charitable purposes) and acceptance by the donee of the gift as restricted.
A charitable pledge agreement is a document that legally binds two or more parties to donate property, money, or services to a charity. For example, a charitable pledge agreement can be used to donate an old car to a local animal shelter or to pledge funds to construct a new elementary school.
A donation agreement will include the names of the parties, a description of the donation, whether a receipt that was given, and possibly the intended use for the donation. The agreement should also include a revocability (whether the donation can be taken back) section and define expense responsibility.
A donation, on the other hand, is a one-time gift. To put it simply: does the money leave a donors wallet now or later and does that money end up in a nonprofit bank account now or later. Most importantly, pledges can be broken.
A legally binding pledge can be made through a written agreement or, in some cases, a verbal commitment with no signed documents. A non-legally binding pledge is merely an expression of the donors intent to give, which has no legal consequences, regardless of if the donor gives or not.
A donation, on the other hand, is a one-time gift. To put it simply: does the money leave a donors wallet now or later and does that money end up in a nonprofit bank account now or later. Most importantly, pledges can be broken.
Basically, a pledge is a promise to pay later while a donation is an immediate payment. So, if a supporter promised to pay $10 a month every month for a total gift of $120 after 12 months, that is a pledge. If the supporter made a one-time gift of $100 for a fundraising appeal, thats a donation.
When Charitable Pledges are Enforceable. Most courts view charitable pledges as legally enforceable commitments. State law determines a pledges enforceability. A conflict can arise between state laws when the donor and the charity are in different states.
