Is E-Verify mandatory? For most employers, E-Verify is voluntary and the overwhelming majority of the nations 18 million employers do not participate in the E-Verify program. By law, E-Verify is mandatory for the federal government, as well as federal contractors and subcontractors.
E-Verify protects jobs for authorized workers and helps employers maintain a legal workforce. Am I required to participate in E-Verify? No. While participation in E-Verify is voluntary for most employers, other employers may be required by State law or Federal regulation to use E-Verify.
To properly complete the E-Verify process, employers must close every case they create, except for cases that result in Employment Authorized, which E-Verify will automatically close.
Employers who participate in E-Verify must sign the E-Verify MOU, the agreement between the employer, the U.S. Department of Homeland Security (DHS) and the Social Security Administration (SSA) and sets the terms of conditions of participation in the program.
States that require all or most employers to use E-Verify: Alabama, Arizona, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Utah. Public employers and/or contractors with the state: Florida, Indiana, Missouri, Nebraska, Oklahoma, Pennsylvania, and Texas. Public employers only: Idaho and Virginia.
Employers who participate in E-Verify must: Follow E-Verify procedures for each employee for whom an E-Verify case is created. Notify each job applicant of E-Verify participation by clearly displaying the Notice of E-Verify Participation and the Right to Work posters in English and Spanish.
Although some states now require employers to register with E-Verify, at least one (Illinois), prohibits employers from such registration because it questions the accuracy of the information contained in the database.
Use of E‑Verify In 2018, DHS had enrolled 821,771 employers in E‑Verifyamounting to 13.5 percent of all employers in the United States (Figure 1). This means that 86.5 percent of U.S. employers refused to use E‑Verify in 2018.
