hes a huge mistake when making a revocable living trust or an irrevocable trust against you for that matter Im Chris small by the way I own CMS Law Firm if you have a state planning questions or probate questions leave them below Ill answer them and follow me because its cool okay um something I see a lot of times uh or not a lot of times we dont let it happen at my firm but I just got to ask this question today is what happens when you are the trustee or the manager of a trust and you are also the beneficiary of a trust uh this person was worried because they had heard from another attorney that in that scenario the trust can be seen as not giving the asset protection or or doing whatever you want it to do because both sides are the same person uh the trust kind of goes away this is called the merger Doctrine and it can happen the best thing to do is to make sure that you have contingent beneficiaries named so people named after you die and if you want to be really safe reporting

To leave property to your living trust, name your trust as beneficiary for that property, using the trustees name and the name of the trust. For example: John Doe as trustee of the John Doe Living Trust, dated January 1, 20xx.
The main disadvantage of a revocable living trust is that it does not protect you from creditors or lawsuits. Because you have control of everything in your trust and have access to the assets, you can still be sued for liability.
How to hide your assets is as simple as the repositioning your assets through an irrevocable trust with a true independent trustee. The key to the transfer is the exchange of equal value in return for the asset, or the receipt of a fair market value for the asset transferred.
There are several benefits of creating a trust. The chief advantage is to avoid probate. Placing your important assets in a trust can offer you the peace of mind of knowing assets will be passed on to the beneficiary you designate, under the conditions you choose and without first undergoing a drawn-out legal process.
While revocable trusts offer no asset protection, irrevocable trusts are outstanding for this purpose. Once one establishes an irrevocable trust, they forever abandon the ability to undo the trust and reclaim property transferred to the trust.
You can hide assets in a trust because they offer a great level of privacy. People wont know what is inside the trust. They wont know if theres a relationship between you and the asset protection trust trust.
A revocable trust turns into an irrevocable trust when the grantor of the trust dies. Typically, the grantor is also the trustee and the first beneficiary of the trust. Once the grantor dies, the terms written into a revocable trust cannot be modified in any way, nor can anyone add or remove assets.
Most trusts can be irrevocable. An irrevocable trust offers your assets the most protection from creditors and lawsuits. Assets in an irrevocable trust arent considered personal property. This means theyre not included when the IRS values your estate to determine if taxes are owed.
