hi John Carter here broker and owner re/max river city in Edmonton and we get this question a lot amendment vs. addendum whats the difference so I thought wed just do a quick video to help explain it so the way I find it easiest is to consider an amendment a change its like what it means in the English language and an addendum a synonym for that is scheduled or appendix so if youre writing an offer and you need additional room to write on that offer more than what the contract paperwork has you can use an addendum or a schedule so you can attach title as the schedule you can attach other documents as a schedule theres already other documents called schedules so you can attach them as an addendum now if youve already gotten accepted offer things have been agreed on and its a pending conditional deal conditionally sold deal then if youre gonna make a change you have to change the offer you have to make an amendment so in that case you sign the amendment and where things get confu

Best practices for contract amendments Always put a contract amendment in writing and make sure both parties sign and date it. Reference the title of the contract, if applicable; its original parties; and original signing date, so that it is clear what document you are amending.
An amendment is typically used to change something thats part of an original contract. Think of amendments as modifications to the earliest agreement (for example, altering an agreed-upon deadline). An addendum is used to clarify and add things that were not initially part of the original contract or agreement.
Addenda are modifications that are added to an existing agreement to add or change a few of its terms or conditions. It does not replace the original contract. It merely adds information that the parties have agreed to after the contract terms have been set.
In addition, the contract addendum is legally binding. Contract addendums act as post-contract attachments, which allow you to alter or modify any previous terms on an existing contract. It means that adding something new to a preexisting contract is possible.
Updated August 13, 2020: If youve entered into a legal contract, an addendum to the contract is any document added after the signing of the agreement to modify its terms while leaving the rest of the contract intact.
It is not illegal to alter a contract once it has been signed. However, it must be materially changed, meaning that if an important part of the contract is altered by the change, it must be made by mutual consent of both parties.
A contract addendum is a post-contract attachment that modifies, alters, or totally changes some of the terms of a previously established contract. Typically, this adds something new to a preexisting document. Once all parties named in a contract agree to an addendum, it becomes a part of the new contract.
An addendum to a contract is a document attached to the original contract that outlines the additions that will be included in the contract. The initial contract is not altered or replaced by addendums.
