Important information: In some cases, a material misrepresentation can be considered a criminal act of insurance fraud. For example, if you intentionally set fire to your home to collect a property insurance payout but file a claim stating the fire was an accident, this would constitute insurance fraud.
Fraudulent nondisclosure or concealment is very similar to the tort of fraudulent misrepresentation, the key difference being that nondisclosure/concealment involves not communicating a fact in order to deceive, rather than affirmatively communicating a false fact.
These are as follows: (i) The insured knew the fact; (2) The insured did not disclose the fact to the insurer, and the insurer was not chargeable with its knowledge; (3) The fact was material; (4) The insured knew the fact was material.
There are two types of misrepresentation: Deliberate or reckless (ie untrue or misleading and which was known to be relevant to the insurer); or. Careless (ie any other misrepresentation).
Concealment is a willful act of holding back information that may be pertinent to the issuance of an insurance policy even though the insured was not asked about that particular subject.
Misrepresentation is a false or misleading statement that, if intentional and material, can allow the insurer to void the insurance contract.
(3)A qualifying misrepresentation is careless if it is not deliberate or reckless. (4)It is for the insurer to show that a qualifying misrepresentation was deliberate or reckless. (b)that the consumer knew that a matter about which the insurer asked a clear and specific question was relevant to the insurer.
Engaging in the most serious type of misrepresentation - intentional fraud.
