In a tenancy-for-years, the agreement is for a fixed period of time. It has a specified beginning and termination date, at which point the tenant is expected to vacate the premises. As the leases end date is already set, there is generally no need for a notice to vacate.
At the beginning of their tenancy, all tenants can be required to give their landlord a security deposit, but it is limited to no more than one months rent. The one-month limit means that a landlord cannot ask for last months rent and a security deposit.
Landlords cannot charge more than one months rent for the security deposit, nor can they demand first and last months rent as a condition of occupancy.
The tenant pays rent for the entire month. California law differs because a 30-day notice is permitted any time during the month, with the final date of occupancy 30 days from the date the notice is delivered to the landlord, ing to the California Department of Consumer Affairs.
A security deposit should not be used as a final months rent. At the end of the lease, if the tenant honored the terms and conditions of the lease and left the apartment in the same condition as it was when initially rented, except for normal wear, the owner must return the full security deposit.
Landlords must accept a tenant-provided background or credit check. The tenant-provided report must be no more than 30 days old. Landlords cannot charge more than one months rent for the security deposit, nor can they demand first and last months rent as a condition of occupancy.
The Housing Stability and Tenant Protection Act (HSTPA) of 2019 limits the amount of a security deposit for any apartment to one months rent. It is unlawful for the owner to ask for an additional amount of money from the tenant, guarantor or third party.
In many cases, landlords cant cancel a month-to-month tenancy for just any reason. They will need a just cause if required the Tenant Protection Act of 2019. In some cases, a landlord can use the 30-day or 60-day Notice to end a rental agreement without a just cause.
