Joint custody, where both parents have custody of all children involved, is preferred and is the most common arrangement, if conditions allow.
3011. In making a determination of the best interest of the child in a proceeding described in Section 3021, the court shall, among any other factors it finds relevant, consider all of the following: (a) The health, safety, and welfare of the child.
This section can be used to award custody of a child to a step-parent or guardian. That is to say that California courts will grant custody to a parent before any third party unless it is not in the best interest of the child to do so.
Its common for parents to ask at what age their child can decide custody. In Massachusetts, children cant decide where they will live until they are at least 18 years old. However, Massachusetts courts must consider a childs custodial preference when the child is mature enough to have a rational opinion.
