A Debt Validation Letter is beneficial in nearly all encounters with a collector. If you don't owe the debt, then the collector is likely to fold because they can't provide validation of the debt. If you only owe some of the debt, then the collector will be forced to prove the amount you actually owe.
When writing a debt settlement letter, it's important to be explicit and detailed. Treat the letter as a contract between you and your creditor. Include your personal information and account number for easy identification. You'll need to outline the amount you can pay and what you expect in return.
Validation and verification letters can be helpful but won't solve all debt collection problems. For example, a collector can continue trying to collect a debt that is past the statute of limitations. They just can't force you to pay it.
A debt validation letter should include the name of your creditor, how much you supposedly owe, and information on how to dispute the debt. After receiving a debt validation letter, you have 30 days to dispute the debt and request written evidence of it from the debt collector.
Two Options for Taking the Settlement Offer Read the settlement offer carefully or have an attorney review the offer to be sure it's legally binding – that the creditor or collector can't come after you for the remaining balance at some point in the future. Or, you can even try to negotiate a lower settlement.
A charge-off means a lender or creditor has written the account off as a loss, and the account is closed to future charges. It may be sold to a debt buyer or transferred to a collection agency. You are still legally obligated to pay the debt.
Your letter should clearly identify each item in your report you dispute, state the facts, explain why you dispute the information, and request that it be removed or corrected. You may want to enclose a copy of your credit report with the items in question circled.
