Employers always demand that employees sign their performance improvement plans. We advise our clients not to sign them, so as to avoid any level of consent or acknowledgment to the bogus narrative strung through the PIP by the employer.
A PIP doesnt mean youre going to be fired. In fact, its actually a good sign that the company wants to help you improve things. Rather than firing you outright, they want to help you develop in your role. So, try to look at it through a more positive lens and take some deep breaths.
How do you write a PIP performance improvement plan? Identify the performance/behavior that needs improving. Provide specific examples for reasoning. Outline expected standard. Identify training and support. Schedule check-ins and review points. Sign and acknowledge.
Answer: Your employer cant force you to sign the performance document, but there may be consequences for refusing to do so. For one, your employer could fire you for refusing to sign. For another, your refusal to sign may disqualify you from receiving unemployment benefits.
What if they refuse to sign the PIP? The employee should be informed that the alternative to a PIP is disciplinary action. The appropriate disciplinary steps should be made in consultation with HR. It is important to document a refusal to participate in or sign a PIP.
Employees do not have to agree with or even sign their performance appraisal. If the employee still opts not to sign, an HR professional and witness can document receipt with their own signatures. They may later be called on to testify that the discipline had been presented to the worker.
