Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
Amendments in applications, other than reissue ap- plications, are made by filing a paper, in compliance with 1.52, directing that specified amendments be made.
While you generally cannot change the description in an existing patent application, you can file a certain continuing application to add new matter or make changes. Such an application is called a continuation-in-part, or simply CIP.
To transfer patent ownership to a company or another entity, each inventor must sign a document called a patent assignment which should then be recorded with the USPTO. First-time patent clients sometimes hesitate to identify inventors, especially when the principals of the company are not the inventors.
In the initial draft claims, the patent agent may. wish to use a picture claim. A picture claim essentially draws a picture of the invention in words. A picture claim is not typically the broadest.
The answer is YES! if a petition is granted explaining why the color drawings or photographs are necessary for illustrating the claimed invention. Under 35 U.S.C. 113, the Applicant for a patent must furnish a drawing where necessary for the understanding of the subject matter to be patented.
Amendments to Claims You can change the claims of a patent without filing a new application unless you are making a new claim. If you are making a new claim, you will need to file a new patent application.
