At the end of the trust deed, your trustee will decide if you can be discharged from the trust deed. To be discharged you must have met all the agreed conditions, such as making payments on time.
Without a deed of trust, it wouldnt be clear how much should be repaid and to who when the property is sold. Instead, all beneficial interests in the property are registered.
A Declaration of Trust is a legal document that declares who owns an asset or property and who will benefit from it. On the other hand, a Trust Agreement is an agreement between two parties where one party agrees to hold assets for another partys benefit.
You may wish to talk to your trust deed firm about this to judge their thoughts. A short break may be viable in the circumstances, with the missed payments made up later. They may also suggest paying every four weeks rather than calendar monthly. Its really up to your trustee though.
If you stop making payments towards your trust deed, without agreement from your trustee, they can: apply for an Earnings Arrestment Order to take the payments directly from your wages. ask the court to make you bankrupt. refuse to discharge you from the trust deed, which will stop your debt being written off.
You cant cancel a deed of trust without the consent of all parties named within the deed. The previous legal document is usually replaced with a new deed or lease contract and it can sometimes condition you to get additional supporting documents.
The most common example of when a declaration of trust is used is the situation where an adult son or daughter borrows money for a deposit on a first house from his or her parents. The parents may have a mortgage already, and the terms of that mortgage prevent them from borrowing under another.
If you have the money to pay off your Trust Deed early, you should speak to your insolvency practitioner and let them know. It may be possible to settle your arrangement early if you can afford all the payments due, as well as any fees associated with setting up your Trust Deed.
