In Ontario, as per the Employment Standards Act, all employees are entitled to take protected, unpaid leaves of absence for the prescribed reasons. In this regard, employees must be reinstated to the same position they held before their leave if it still exists, or to a comparable position if not.
Termination and a Lawful Leave of Absence So long as your stress leave is documented and supported by a valid doctors recommendation, you are protected under disability laws while on leave. Your employment cannot be terminated because you decided to go on leave.

It is not appropriate for an employer to determine what may or may not be urgent in an employees or student interns circumstance. Only when the employees or student interns reason is clearly not urgent and it is obvious that abuse is occurring, would it be appropriate for an employer to deny a personal leave.
If the reason for voluntarily taking a period of leave is without just cause, you will not be paid regular benefits for the entire period of the leave. However, you may still be paid maternity, parental, sickness and compassionate care benefits as long as you qualify for these benefits.
Duration. You can request leave without pay for personal needs for either up to 3 months or for more than 3 months but up to one year.
Termination of employment Employees cant be terminated or laid off while on a job-protected leave unless the employer suspends or discontinues the business.
Yes, your employer can refuse your vacation request. Employers in Ontario have the absolute right to decide when their employees can use their vacation days, considering business needs. For example, many companies have a policy not to allow vacations during the Holiday season.
