Yes, franchisors reserve the right to make company-wide decisions, but you can negotiate in the agreement your right to obtain certain waivers and a period of time to make any necessary changes when the franchisor makes major decisions that affect your franchise.
A well-written franchise agreement serves the purpose of protecting a franchisors brand. It also clarifies the rights and obligations of each of the parties - the franchisor and the franchisee - and ensures consistently and quality across each of the franchisors various locations.
So, major structural changes such as the amount of the franchise fee, royalty rates, and the franchisees overall obligations related to the development and operation of the franchised business are typically non-negotiable.
For example, one franchisee might get a larger territory, or an extra year on the contract deadline, but when it comes to franchise fees, royalty rate, and other (especially financial) terms of the agreement these points are not negotiated.
Franchise fees are the payments that franchisees make to franchisors for the right to use their brand, system, and support. Franchise fees vary depending on the type, size, and location of the franchise. However, they are not set in stone and can be negotiated to some extent.
These fees are not typically negotiated as they are standard per the Franchise Disclosure Document and Franchise Agreement. Reducing or deferring royalties can be detrimental to the long-term success of a franchisor and franchisees.
What: The agreement should include a detailed description of the business operation and any relevant metrics. Requirements set by the franchisorincluding how the property is to be maintained, how much insurance must be carried, how records must be kept, what hours the business must be open should all be detailed.
To be clear: Franchise agreements are negotiable. It is not illegal for a franchisor to modify its franchise agreement. It is extremely common for franchisees to negotiate certain aspects of the franchise agreement.
