I will be providing a demonstration today on the Patent Public Search tool with an emphasis for design searching and examination. Ill also be using the abbreviation abbreviation PPUBS to refer to this tool. So lets go ahead and get started. I will go ahead and share my screen. So there are a couple different ways you can access this tool. The first is via a direct hyperlink, which well include in the notes of this video. While you generally cannot change the description in an existing patent application, you can file a certain continuing application to add new matter or make changes. Such an application is called a continuation-in-part, or simply CIP.
You cannot reapply for the same invention covered in an existing patent. You can, however, file patent applications for improvements and modifications. The extent of your changes will determine whether your new patent application will be considered non-obvious over prior patents.
A patent claim is typically comprised of three essential parts (as shown in Figure 2 below) the preamble, the transitional phrase (or word), and the body. The preamble is an initial introductory statement that states the category of the invention to be claimed.
A claim may be written in independent or dependent form. An independent claim is a standalone claim that contains all the limitations necessary to define an invention. A dependent claim must refer to a claim previously set forth and must further limit that claim.
A Jepson claim is a type of patent claim that describes an improvement to an existing invention. It starts with a statement about the current state of the art, followed by the phrase the improvement comprising and a description of the claimed patentable improvement.
In the initial draft claims, the patent agent may. wish to use a picture claim. A picture claim essentially draws a picture of the invention in words. A picture claim is not typically the broadest.
