The IRS cannot cancel your EIN. Once an EIN has been assigned to a business entity, it becomes the permanent Federal taxpayer identification number for that entity. Regardless of whether the EIN is ever used to file Federal tax returns, the EIN is never reused or reassigned to another business entity.
If you reported your EIN incorrectly, please file a W-3c to correct it. Make sure you use the Employer Identification Number (EIN) issued by IRS on all Forms W-2c/W-3c. Note: The same EIN number should be used on the Form 941-x, Supporting Statement to Correction Information, when applicable.
To correct the error, you would need to file an amended return with the IRS. If you fail to correct the mistake, you may be charged penalties and interest. You can file the amended return yourself or have a professional prepare it for you.
If you have lost your EIN Verification Letter from the Department of Treasury, you can request a new one. To do so, call the IRS Business Specialty Tax Line toll free at 1-800-829-4933 between the hours of 7am and 7pm in your local time zone.
Generally, businesses need a new EIN number if the business structure has changed. For example, you convert your LLC to a corporation. The IRS also requires you to obtain a new EIN number if you form: A new (separate from your current) LLC with more than one owner (Multi-member LLC) is formed under state law.
