Like any other identity problem, the solution for error code 101 requires you to clarify your right to use the name of your business. In most cases, you must communicate directly with the IRS through the mail, fax, or phone.
If you realize there was a mistake on your return, you can amend it using Form 1040-X, Amended U.S. Individual Income Tax Return. For example, a change to your filing status, income, deductions, credits, or tax liability means you need to amend your return.
EIN Denial Based on Business Similarity If you do have a valid Social Security Number or ITIN, then the most common reason for a denial would be that your business is too similar to another that is already on record.
Generally, businesses need a new EIN number if the business structure has changed. For example, you convert your LLC to a corporation. The IRS also requires you to obtain a new EIN number if you form: A new (separate from your current) LLC with more than one owner (Multi-member LLC) is formed under state law.
