Section 33 allows Parliament or the legislature of a province to derogate from certain sections of the Charter, namely section 2 (fundamental freedoms), sections 7 to 14 (legal rights) and section 15 (equality rights).
In essence, a compelled witness who provides incriminating evidence in any proceeding is protected against the use of that evidence to incriminate them in any other proceeding. The rationales underlying the protection include the need to protect against unreliable evidence and abuse of power by the state.

Section 11(a) of the Charter is premised on the legal principle that every accused person is entitled to know the nature of the allegation against them at an early juncture so that they can make informed decisions in their defence. This is an essential aspect of the common law conception of a fair trial.
13. A witness who testifies in any proceedings has the right not to have any incriminating evidence so given used to incriminate that witness in any other proceedings, except in a prosecution for perjury or for the giving of contradictory evidence.
Section 13 states that witnesses who give evidence in court cannot have their testimony used against them in other proceedings. Section 31 of the Canadian Charter of Rights and Freedoms is a part of the Constitution of Canada, which clarifies that the Charter does not increase the powers of either the federal government or the legislatures of the provinces of Canada.
