hey you guys amanda brown first american title insurance company todays video will be about affidavit of deaths affidavit of death is a document that is recorded with the countys recorders office it establishes the death of a person who has been on title so the reason why we do that is if well just say husband and wife join tenants someone passes away we have to establish why that person is not signing the grantee when they are selling a house so we require an affidavit of death to be filed that is drawn up by escrow and typically we see either an affidavit of death of like i just said joint tenant or affidavit of death of trustee for example its basically however title is held so the affidavit of death is drawn up by escrow we do require because the county requires an original death certificate an original death certificate if your client if the owner does not have one we can order one it does take some time to get back so please let us know the sooner the better maybe right when

Complete and submit an Application for Amendment to Death or Fetal Death Record DH Form 524 along with the affidavit. NOTE: This affidavit is sufficient for some minor corrections. However, many corrections must be supported by submission of documentary evidence.
How Do I Record an Affidavit? Take a certified copy of the death certificate of the deceased joint tenant and your affidavit to the recorders office in the county where the real property is located.
For example, if A and B Joint Tenants form a revocable trust with each other as beneficiaries, A and B both become Original Transferors. When the property passes to the other upon the death of A or B, the real property is not reassessed.
Terminating Joint Tenancy If parties hold title as joint tenants and one is deceased, the survivor may file an Affidavit of Death of Joint Tenant. It may be advisable to consult an attorney due to the legal aspects involving a change in ownership of real property.
Amendments are used to correct errors on the death certificate. Documentation supporting the correction may be requested and not returned.
Joint tenancy differs in key respects from property co-owned through a partnership or tenancy in common. Most notably, joint tenancy comes with a right of survivorship. This means that when one joint tenant dies, the other joint tenant or joint tenants acquire the deceased joint tenants interest in the property.
