A subordination agreement must be signed and acknowledged by a notary and recorded in the official records of the county to be enforceable.
Because it was raining, I took my raincoat with me. If you tidy your bedroom, well go to the cinema later. Ill go to sleep when Ive finished reading my book. Since everyone is not here yet, well wait a few minutes.
A subordination clause is a clause in an agreement that states that the current claim on any debts will take priority over any other claims formed in other agreements made in the future. Subordination is the act of yielding priority.
Subordinate clauses will often begin with subordinating conjunctions, which are words that link dependent clauses to independent clauses, such as for, as, since, therefore, hence, consequently, though, due to, provided that, because, unless, once, while, when, whenever, where, wherever, before, and after.
Two types of subordination agreements are: Executory Subordination and Automatic Subordination. These differ in the timing of when priority rights are given and the contractual performance required by the subordinated party.
Subordination clauses are most commonly found in mortgage refinancing agreements. Consider a homeowner with a primary mortgage and a second mortgage. If the homeowner refinances his primary mortgage, this in effect means canceling the first mortgage and reissuing a new one.
