In todays episode, were going to talk about what trademark symbol should you use: the circled R or the little capital letters TM? So, the circled R can only be used if you have federally registered your trademark. This doesnt mean youve just applied for the trademark and gotten a serial number. It means youve gone through the eight to ten month long registration process and actually have a trademark registration certificate. Very important not to use a circled R before that point because its actually a violation of federal law to do so. And if the USPTO sees that youre using the circled R in the marketplace, they will actually deny your trademark application. So while youre waiting for your registration to issue, you can use the little capital letters TM next to your trademark.
