If a borrower defaults on a loan, the lender may pursue legal action to collect the remaining loan balance. The promissory note will typically outline the actions the lender may take in the event of a default, such as hiring a collection agency or filing a lawsuit.
A promissory note typically contains all the terms involved, such as the principal debt amount, interest rate, maturity date, payment schedule, the date and place of issuance, and the issuers signature.
A default on a loan happens when the borrower fails to make the scheduled payments in full. Default could happen with one missed payment or might not occur until after several payments have been missed, depending on the terms of the note.
In some areas of the country, real estate settlement is completed at what is known as a table closing. A table closing involves a number of people. Typically, the buyer and seller attend the closing along with their real estate agents. A real estate attorney, settlement agent or title agent may conduct the closing.
In such cases, the payee may take legal action against the maker to recover the outstanding amount, and the dishonored note can negatively impact the makers creditworthiness. When a note is dishonored, the company must recognize the adjustment in the book of accounts as follows.
Promissory notes are legally binding whether the note is secured by collateral or based only on the promise of repayment. If you lend money to someone who defaults on a promissory note and does not repay, you can legally possess any property that individual promised as collateral.
A comprehensive promissory note typically includes: Names and contact information of the parties involved. Loan amount. Repayment terms. Interest rate (if applicable) Consequences of default (in case payments are missed) Governing law. Signatures of the borrower and lender.
If the borrower does not repay you, your legal recourse could include repossessing any collateral the borrower put up against the note, sending the debt to a collection agency, selling the promissory note (so someone else can try to collect it), or filing a lawsuit against the borrower.
