Ive got the property, but I got to get a tenant into it. So what are some of the concerns that you need to be aware of as a as a landlord when it comes to working with tenants? For a fixed-term tenancy (or lease) agreement At the end of the period, the landlord and tenant can agree to another fixed term or continue the tenancy on a month-to-month basis.
The make good obligation usually begins at the end of the lease term. In other words, you will only return your space to its original condition or as described in the lease. Therefore, you are responsible for any repairs and/or replacements required to bring it back to that standard.
The landlord must apply to the Landlord and Tenant Board (the Board) for an order allowing the eviction of the tenant. The tenant has the right to go to a hearing and explain why they should not be evicted.
You must provide the landlord with your notice no later than 30 days after the landlord gives you the standard lease. In either case, you must provide the landlord with a written notice to terminate the tenancy at least 60 days before the last day of a rental period.
How Long Does It Take to Evict a Tenant in Ontario? Unfortunately, eviction is not a speedy process. It can take anywhere from 85 138 days to evict a tenant after an eviction notice has been given. If the tenant needs to be removed by the Sheriffs office, the timeline could stretch to 168 days.
Landlords are not allowed to require tenants in Ontario to sign a new lease and cant evict you for not signing a lease renewal. In order to become a month-to-month tenant you dont have to do anything. Your contract AUTOMATICALLY becomes a month-to-month contract when your lease expires.
When landlords get new tenants, they usually ask them to sign a minimum of 12 months lease. This is meant to provide them with some peace of mind knowing that the premise will be occupied for the following year. However, Ontario tenants can break the leases with relative ease even though it is considered binding.
In Ontario, when a residential lease expires, and there is no new lease, the tenancy automatically becomes a month-to-month tenancy.
