The power of attorney can start as soon as you sign it, or it can start on a specific date that you write in the document. An enduring or continuing power of attorney is a legal document that lets your attorney continue acting for you if you become mentally incapable of managing your finances and property.
Each province has signing requirements, but ordinary and continuing POAs usually dont have to be docHubd if you are physically and mentally capable when designating them. Although, there are two good reasons for notarization. First, it ensures your POA document has a genuine official-looking signature.
Power of attorney documents need to be signed and witnessed in order to be legally-binding in Ontario. The law requires that two people witness your signature. The witnesses must be present at the same time, and sign the last page with you together.
The right to compensation Unless the power of attorney expressly excludes compensation, in Ontario an attorney for property is generally entitled to compensation at the following rates: 3% of income and capital receipts. 3% of income and capital disbursements. 0.6% per year of assets under management.
You must be the age of majority in Ontario (At least 18 years old to make a power of attorney for property and at least 16 years old to make a power of attorney for personal care) You must sign your document in the presence of two valid witnesses who must also sign the document.
You do not need a lawyer to draft your enduring power of attorney or representation agreement in BC. However, there are some criteria you need to meet in order for it to be legal.
