The primary factor in this calculation is the income of both parents. The court takes into account both the custodial parents income and the non-custodial parents income.
The California child support statutes commonly allow a modification petition to be filed every three years or if there has been a substantial change in circumstances since the original order was decreed. Usually, the most common reason for a change in your child support is a change in income for either parent.
In relation to receiving a payment modification, this phrase applies to one of these situations: The noncustodial parents income has increased or decreased. The noncustodial parent is legally responsible for additional children. The childs (or childrens) medical insurance coverage has changed.
