welcome once again to latos law heres Steve lato Bob sent me a one sentence email and said Steve can you please explain a mechanics lien or a garage keeper lean and Im specifically talking about the liens that have to do with automobiles some states have got mechanics liens and they actually use that in reference to any work done uh for instance on a piece of property you bring in a plumber and he works in your house and you refuse to pay him in some states that Palmer may be able to file a lien against your property to assure that he gets paid if nothing else at least when the home gets sold so Im talking about garage keeper liens or mechanics liens on automobiles because in Michigan they are authorized by MCL 570.301 at sac and theyve been around for a long long time and believe it or not years ago I had a friend who owned a gas station and he also did mechanical work there and at one occasion somebody brought a vehicle in and asked him to do the work sign the authorization did

Under the Ontario Construction Lien Act a lien must be registered at the Land Titles Office within 60 days from the date the work is completed or the materials supplied to the project job site.
In Ontario, there is the Construction Act. This allows anyone supplying service or materials to put a lien on the property. This applies to anyone who provides services for either the owner, a contractor or even a subcontractor. The only exception to this is if the owner is the federal or provincial crown.
A car lien is a lenders claim for repayment that they register against a car or other type of motor vehicle. Lenders have the right to place a lien on your car. Other companies like garages also have that right. Its called a mechanics lien. Liens stay registered on your car until youve paid your debt in full.
Your lien is only valid for 180 calendar days from the date it is registered on the land title. 3. If you want your lien to last longer, you must file a statement of claim at the Court of Kings Bench and obtain a Certificate of Lis Pendens (CLP) from the clerk of the court and file it at Land Titles.
Mechanics Liens are a risk management tool to leverage payment from an overdue customer. A Mechanics Lien in these provinces ensures you have a secured interest in a property you have worked on- or supplied materials to a job site. Generally, liens are a collection tool in the event of non-payment.
A lien must be perfected prior to 90 days from the last date on which the lien could have been preserved. Therefore, in total, a Lien Claimant has 150 days to preserve and perfect their lien from the earlier of the contract being completed, abandoned or terminated.
Lien Registration Fees The fee to register a construction lien in Ontario is $71.20, as of March 2023. This fee is payable to the Ministry of Government and Consumer Services. Discharge Fees If the lien is discharged, there may be additional fees involved.
Of the three types of liens (consensual, statutory, and judgment), the judgment lien is the most dangerous form, but one which the informed business owner may be able to eliminate. A judicial lien is created when a court grants a creditor an interest in the debtors property, after a court judgment.
