An appellate court may issue its opinion, or decision, in as little as a month or as long as a year or more. The average time period is 6 months, but there is no time limit.
An appellant who has lost their appeal has several options based upon the nature of the civil or criminal case. These include filing a motion for a rehearing, filing an application for a writ of habeas corpus, attempting to transfer the case, and appealing to the highest court.
An appeal is the legal process to ask a higher court to review a decision by a judge in a lower court (trial court) because you believe the judge made a mistake. A litigant who files an appeal is called an appellant. A litigant against whom the appeal is filed is called an appellee.
The losing party in a lawsuit may appeal their case to a higher court. The higher court then reviews the case for legal errors. If an appeal is granted, the lower courts decision may be reversed in whole or in part. If an appeal is denied, the lower courts decision stands.
In most situations, if you win your appeal, you case will be remanded. This means the case will be sent back to the trial court or judge responsible for your conviction and/or sentencing.
Most appeals are final. The court of appeals decision usually will be the final word in the case, unless it sends the case back to the trial court for additional proceedings, or the parties ask the U.S. Supreme Court to review the case.
