Generally, yes. Someone without a lease may be evicted, or removed from a property, so long as state and local laws are followed. Most landlords will require all adults who live in a rental property to have their name and signature on the lease.
Under California law, landlords must give tenants at will 30 or 60 days written notice, depending on how long the tenant has lived in the unit. Additionally, tenants at will have the right to quiet enjoyment of their rental unit.
If there is no lease, either written or oral, a landlord still can evict you. This is because the lack of a lease means that you are in a month-to-month tenancy at will and must pay rent on a monthly basis, or more frequently if you have an agreement to that effect.
In California, residential rental agreements automatically convert to month-to-month tenancies at the end of your lease term. At the end of each month thereafter, the agreement renews automatically for themselves in perpetuity as long as you, the tenant, remain in possession of your home.
The rules differ depending on which type of rental agreement exists between landlord and tenant. Under California state law, a landlord can terminate a month-to-month tenancy by serving a 30-day written notice if the tenancy has lasted less than one year, or a 60-day notice if the tenancy has lasted more than one year.
Under California law, residential tenants are protected from certain rent increases and may be protected from certain types of evictions. It is important to act quickly if your landlord serves you with an eviction notice, tells you to move out, increases your rent illegally, or if you know cannot afford your rent.
But, your landlord can still require you to move out for one of the no-fault reasons listed in the law. If your landlord evicts you for one of these reasons, they must first give you one months rent or waive one months rent to help you move out.
If your lease expires, the landlord has to provide you with a 30-day, 60-day, or 90-day notice to leave, depending on how long youve been renting and if youre in subsidized housing. If youve been renting for less than a year, the landlord only needs to give you 30 days notice.
