A quitclaim deed offers purchasers the least amount of protection because it does not provide guarantees that the seller is the rightful owner and has the authority to transfer. Rather, the quitclaim deed evidences the grantors relinquishing right to the title.
A grantor would ideally prefer to give a quitclaim deed because it frees them of liability for any title problems. On the other hand, the grantee is best protected by a general warranty deed.
Explanation: Since there are no warranties in a quitclaim deed, signing it creates no liability for the grantor.
General warranty deeds give the grantee the most protection, special warranty deeds give the grantee more limited protection, and a quitclaim deed gives the grantee the least protection under the law.
A deed transferring title to real property from a grantor to a grantee. In Florida, a warranty deed (also called a general warranty deed) provides the grantee with broad warranties and covenants of title and is the customary form of deed used in residential real property transactions.
