So remember, in the event of a simple breakup, where neither party is married, but they have shared a dog, the person who bought the dog, the person who can prove that the dog is their property, is the one who usually gets to keep that possession or the dog.
The party who owns the pet will usually get to keep it. If the pet is owned by both parties, the court may require one party to purchase the other partys interest in the pet.
Consider joint custody Since cats prefer routine, most cats will not do well with such an arrangement and may start to exhibit stress-induced health issues if they are forced to shuttle back and forth between two residences.
If negotiation or mediation does not work to resolve the pet ownership, the court will make a decision for both of you. If both of you are emotionally attached with your pet, the court may award joint custody to both of you. If the court sees the situation differently, the pet may get to stay only with one pet-parent.
If you and your ex are fighting over a shared pet during a breakup, but not a divorce, the matter becomes more complicated. In general, although there are some exceptions, you would not take legal action until or unless your ex physically takes the pet from you without your permission.
The best solution is to settle pet custody outside of court, and to come to a mutual decision together. These can be hard conversations to have but, if you can, sit down with your partner and discuss what the arrangements for your pets future should be, and whether the decision you have made will be the best for them.
Proof of ownership: If you were not the one who originally brought the animal home, do not give up. Information that may help to validate your claims as primary caregiver includes: receipts for veterinary care, grooming, dog training classes, food, and other items purchased for the companion animal.
It is treated exactly the same as any other material good in the home (as far as ownership goes; obviously, anti-cruelty laws are available to pets but not to recliners). That means that when a couple goes through a divorce, a pet whose custody is in dispute becomes part of the divorce order issued by the court.
We often receive the question, can I sue my ex for stealing my dog? The answer is yes! Disputes over pets are very common in small claims court.
If you and your former partner were married and are seeking a divorce, the issue of who gets the pet will bewared up in your divorce case. If you were not married, however, youll have to file a lawsuit on your own. In most cases, small claims courts are equipped to handle a pet custody issue.
