Landlords may end a tenancy for renovations or repairs if: The renovations or repairs are necessary to prolong or sustain the use of the rental unit or the building in which the rental unit is located.
Your notice must be in writing, so avoid email, text messaging, and social media. Instead, give your landlord a signed and dated letter with your name, signature, address, and move-out date, as set out in section 52 of the RTA. See TRACs template letter, Notice to Move Out.
Tenants have rights during a tenancy, including their rights to dispute problems and their quiet enjoyment rights. Landlords cant physically remove tenants or lock them out of their rental units.
Check if your tenancy agreement says anything about how you should give notice. If it doesnt say anything, give notice by writing a letter to your landlord. Its a good idea to ask your landlord to confirm in writing theyve received your notice.
If your landlord does not respond or refuses to address the issue within a reasonable period (usually between 15-30 days), you can apply for a repair order through the Residential Tenancy Branchs dispute resolution service.
Can a landlord remodel while occupied? Yes, and if the work that needs to be done is not overly disruptive or is just a few minor upgrades, then your tenant can stay put.
Section 49 gives reasons for which a landlord can end a tenancy. This includes an intent to occupy the rental unit or to use it for a non-residential purpose (see Policy Guideline 2B: Ending a Tenancy to Demolish, Renovate, or Convert a Rental Unit to a Permitted Use).
