Claim chart/ mapping involves breaking of a claim into its constituent elements and comparison of each element of the claim with the third partys process or technology or product in the case of infringement analysis. In case of invalidation, the claim elements are compared with the prior art(s).
Claims charts are used to illustrate how a product or service is allegedly infringing a patent claim . Infringement must be proven by showing that the product or service (the use) infringes each and every element of the asserted claims.
EoU refers to the identification of potentially infringing products present in the market for evaluating the strength of patent infringement assertion. A claim chart is a graphical or tabular representation that analyzes each patent claim by breaking it up into its constituent elements or limitations.
The Evidence of use claim charts are used determine the extent to which the third partys technology falls within the patent claim of the petitioner. It helps to detect potential infringement of patents.
Structure of the specification A patent specification normally has the following parts in the order given: A title to identify the invention. A statement as to the field to which the invention relates. An explanation of the background state of the art what was already known prior to the invention.
In each, typically, there are two columns: the left column contains the language of the patent claim under analysis, separated into the successive limitations (e.g., elements or steps, integers, parts) of the claim; the right column contains the information relating to the claim element at its left.
A patent claim chart is simply an effective tool for analyzing and presenting information regarding a patent claim. There is also a cousin of the claim chart, called a specification chart (or spec chart) that we do not discuss in the video above, but may present in a future presentation.
