Generally, if your household income is 100% to 400% of the federal poverty level, you will qualify for a premium subsidy. This means an eligible single person can earn from $13,590 to $54,360 in 2022 and qualify for the tax credit.
If at the end of the year youve taken more premium tax credit in advance than youre due based on your final income, youll have to pay back the excess when you file your federal tax return. If youve taken less than you qualify for, youll get the difference back.
Avoiding or Reducing Premium Tax Credit Repayments The key to reducing the amount of premium tax credits you have to repay is keeping your household income below 400% of the federal poverty level. As long as your income is below this level, your repayments are capped.
Again this year, people with annual income up to 150% of FPL ($20,385 for a single person and $34,545 for a family of 3 in 2023) will be able to enroll in marketplace plans year-round.

For the 2023 tax year, the excess subsidy repayment limits will vary from $350 to $3,000, depending on income and tax filing status (as always, repayment caps only apply if your income is under 400% of the poverty level; above that amount, any excess premium tax credit must be repaid, regardless of how much it is).
For the 2022 tax year, you must repay the difference between the amount of premium tax credit you received and the amount you were eligible for. There are also dollar caps on the amount of repayment if your income is below 4 times the poverty level.
The credit is refundable because, if the amount of the credit is more than the amount of your tax liability, you will receive the difference as a refund. If you owe no tax, you can get the full amount of the credit as a refund.
APTC are tax credits consumers can use to lower their monthly insurance payments (called their premiums) when they enroll in a plan through the Marketplace. The APTC amounts consumers receive are based on their estimated annual household income and their household size as reported on their Marketplace applications.
