Step 1: Complete the Request to File an Agreement form. This form is available online at .gov.bc.ca/court-forms or at any Provincial Court Registry. Step 2: File the Request to File an Agreement form and written agreement at the Provincial Court Registry. You must file at the Provincial Court Registry:
Anyone can draft their own separation agreement and as long as it includes certain information, is signed by both spouses and witnessed it is legally binding.
You dont have to file your completed separation agreement in court. But if you do, you can file in BC Provincial (Family) Court or BC Supreme Court. Filed agreements that include terms about parenting and support can be enforced as if they are court orders.
Its $210 to file the first documents (a $200 filing fee, plus $10 for a Registration of Divorce), and then $80 to file your Final Application. If you decide to get a Certificate of Divorce, thats another $40. (Theres no tax on these costs.)
You and your spouse can write the agreement yourselves or you can ask a lawyer, family justice counsellor, or private mediator to help you. If you decide to write your own agreement, read as much as you can about separation agreements before you start to write it.

Fill out Form 26B: Affidavit for Filing Domestic Contract or Paternity Agreement, and attach your current separation agreement to it. You have to file Form 26B and your separation agreement at the Ontario Court of Justice or the Family Court branch of the Superior Court of Justice.
While you can draft your own separation agreement, before you sign it, you should have a lawyer review it . This is called independent legal advice. Some lawyers may only charge you for reviewing the agreement. You should ask a lawyer if they offer unbundled services and what they will charge for a review.
