Canada, the Philippines, and the United States were among the only countries to use first-to-invent systems, but each switched to first-to-file in 1989, 1998, and 2013 respectively.
In a first-to-file system, the rights to the trademark go to the first person or business that registers the trademark with the IP office. Conversely in a first-to-use system, a person or business using the trademark first in commerce will receive ownership over the IP.
In certain countries, such as the United States and Canada, first-to-use trademark systems are in place. This means that trademark rights are given to marks that have been used in commerce the longest, granting priority in the jurisdiction of use to which you would like to apply.
The 1(a) filing basis, or the use-based application, is applicable when the mark you intend to register is already in use across state lines, US territories, or between the US and a foreign country. The use in commerce refers to the legal commerce that US Congress can regulate.
In the US, trademark rights generally go to one who was first to use the mark in commerce, meaning that whoever was first to use a mark on certain goods or services would be presumed the lawful owner of the trademark.
A date of first use in commerce is the date when (1) the goods were first sold or transported, or the services were first rendered, under the mark in a type of commerce that may be lawfully regulated by the U.S. Congress (such as interstate commerce or commerce between the United States and a foreign country), and (2)
Instead, first use means the earliest date on which (1) the goods or services for which the mark is being registered were sold (or offered and available to customers) in the ordinary course of trade, AND (2) the mark was used in conjunction with the commercial sale or offering for sale of those goods or services.
