If a tenant commits a substantial bdocHub, the landlord can apply to the RTDRS or Court to end the tenancy, or give the tenant at least 14-days notice to end the tenancy. A tenant must be given the notice at least 14 clear days before the tenancy is to end.
Section 48(1) of the RTA permits the landlord to give notice of termination to a tenant if the landlord, in good faith, requires the unit for residential occupation for a period of at least one year by the landlord, a specified family member or a caregiver. This notice is often referred to as a N12 notice.
Sign N11, Ask for 2 month+ compensation, you can ask up to 3-4 months compensation (most LL might be okay with this), but if landlord doesnt care about immediate occupancy they might not give you that and wait for hearing. N12, you get 1 month compensation and you wait for eviction. 6-8 months for eviction. N11 vs n12? : r/OntarioLandlord - Reddit Reddit OntarioLandlord comments Reddit OntarioLandlord comments
An N12 notice is one kind of eviction notice where the landlord tells you they want you to move out. Its important to know that getting an N12 does not mean you must move out. If you disagree, the Landlord and Tenant Board (LTB) will decide what happens.
I should mention that many of todays buyers who intend to move into the home for their use request a signed N11 rather than relying on an N12 notice because the Buyer is more confident that the tenant will move out with a signed N11.
N11: A mutual agreement between the landlord and the tenant to end the tenancy. N12: A notice to end the tenancy because the landlord, a purchaser, or a family. member will be moving into the unit. Forms All Landlords in Ontario Should Know (and When to Rhenti landlord-forms Rhenti landlord-forms
