These liens are perfected by filing a UCC-1 Financing Statement showing the name and address of the debtor and the secured party along with a description of the collateral. These financing statements are effective for five years and may be continued for an additional five years.
A mechanics lien is a hold against your property, filed by an unpaid contractor, subcontractor, laborer, or material supplier, and is recorded with the county recorders office. If unpaid, it allows a foreclosure action, forcing the sale of the property in lieu of compensation.
How Is Priority Determined? Liens generally follow the first in time, first in right rule, which says that whichever lien is recorded first in the land records has higher priority than later recorded liens.
A mechanics lien must be filed with the Circuit Court in the county where the real property is located. Once a mechanics lien is filed, the contractor, subcontractor, or supplier must then file a petition to enforce the mechanics lien in the proper court within six months after the filing of the lien.

Timely filing Typically, the right to seek a mechanics lien ends six months after the completion of work on the project or the delivery of the materials. After securing a lien, there is another six-month deadline that applies to enforcing it, a process that often involves foreclosure.
Missouri Mechanics Liens Subcontractors and suppliers who do not have a direct contract with the property owner may only file a mechanics lien if the owner has signed a Consent of Owner document allowing mechanics liens.
