Do I need an attorney to write my Last Will and Testament? You are encouraged to consult with an attorney to prepare your Last Will and Testament. However, a document may be a valid will provided it complies with Marylands legal requirements for a valid will.
Understanding Legal Requirements for a Valid Will If the testator (the person creating the Will) lacks the testamentary capacity for reasons like dementia, mental illness, or the influence of medications or substances, this could void a Will.
As mentioned above, in Maryland, you should have your POA docHubd and witnessed. The notary public can act as one of the two required witnesses.
Maryland Law requires that any one holding an original Will and/or Codicil(s) must file that document with the Register of Wills promptly after a decedents death even if there are no assets.
Power of attorney for your health (Advance Directive) You can appoint someone to make medical decisions for you by completing the Maryland Advance Directive Form. Two witnesses must co-sign the form. The form does not need to be docHubd.
In Maryland, a valid will must be (1) in writing, (2) signed, and (3) attested and signed by two credible witnesses. It may be handwritten or typed and any two adults can be witnesses. A will does not require a notary, though a notary can be a witness.
In order for an online Will to be valid in Maryland, it must satisfy the following requirements for all Maryland Wills regardless of the method used: The Will must be in writing. The Testator (the person writing the Will) must be at least 18 years old and be of sound mind.
Legal Formalities: In Maryland, the POA document must be signed by your parent in the presence of a notary public. Two adult witnesses who are not the agent or the notary must also sign the document. Store the Document Safely: Keep the original POA document in a safe but accessible place.
