While faxing is technically HIPAA-compliant, its not an efficient or convenient way to share patient information. Not to mention, faxing does not allow for easy collaboration between providers and patients.
When sending a fax, include a cover sheet indicating the date and time sent; the recipients name and fax number; and the senders name, organization and phone number. The fax cover sheet should NEVER include a patients name or any other PHI. 2. Include a privacy statement in the fax cover sheet.
Every time you fax a document containing PHI, you are required by HIPAA to use a fax disclaimer with the approved statement warning against unauthorized access. This document informs the receiver that incoming faxes contain personal information that is not to be distributed or disclosed without permission.
A HIPAA fax cover sheet disclaimer is a message addressed to the fax recipient, that states that the faxed information is confidential. The disclaimer also should state that the transmission may contain protected health information.
Example of a good HIPAA disclaimer: This transmission is intended for the sole use of the individual or entity to whom it is addressed. If you are not the intended recipient, you are notified that any use, dissemination, distribution, printing or copying of this transmission is strictly prohibited.
An example of a fax disclaimer statement: If you are not the intended recipient, please be advised that any disclosure, copying, distribution, or use of the contents of this information is strictly prohibited, and that any misdirected or improperly received information must be returned to this company immediately.
IMPORTANT WARNING: This facsimile is a confidential communication and is transmitted for the exclusive use of the person or entity to which it is addressed. If you are not the intended recipient you are hereby notified that any disclosure, copying or distribution of this information is STRICTLY prohibited.
HIPAA compliant faxes containing protected health information should always include a cover sheet that includes a confidentiality statement, as well as the name of the recipient, their fax number, and the name, organization, and contact information of the sender.
