An offer in compromise allows you to settle your tax debt for less than the full amount you owe. It may be a legitimate option if you cant pay your full tax liability or doing so creates a financial hardship.
IRS Hardship status can last up to 10 years. Generally, the IRS has 10 years to collect back taxes, after which time they are supposed to remove the back taxes. For example, if you filed your 2009 tax return on time and you owe back taxes, The IRS can collect the back taxes until 2020.
You do not have to prove hardship to take a withdrawal from your 401(k). That is, you are not required to provide your employer with documentation attesting to your hardship.
This may include insurance bills, escrow paperwork, funeral expenses, bank statements, etc. Documentation to support that the hardship was made properly and in ance with the plan provisions and the IRS regulations. Evidence that the payment was made to the participant and reported on Form 1099R.
To prove tax hardship to the IRS, you will need to submit your financial information to the federal government. This is done using Form 433A/433F (for individuals or self-employed) or Form 433B (for qualifying corporations or partnerships).
In order to qualify for an IRS Tax Forgiveness Program, you first have to owe the IRS at least $10,000 in back taxes. Then you have to prove to the IRS that you dont have the means to pay back the money in a reasonable amount of time.
